Legal centreTerms & Conditions
The rules for competitions, instant wins, accounts, prizes, free entries and responsible play.
These Terms govern competitions, prize draws, instant-win formats, free giveaways, paid and free entries, promotions, account features and rewards offered by Proper Wins through properwins.co.uk.
Each competition page contains specific details such as the opening and closing time, entry price, maximum entries, per-person limits, prize, cash alternative where offered and draw or result mechanism. Those details form part of these Terms.
The promoter
The promoter is Proper Wins, the UK business operating properwins.co.uk. Contact: support@properwins.co.uk. Business correspondence address: 5 Brayford Square, London, E1 0SG, United Kingdom.
Unless a competition page expressly states otherwise, competitions are offered to eligible residents of England, Wales, Scotland and Northern Ireland.
Contract and order of precedence
These Terms, the relevant competition page, the Free Entry Route, Privacy Policy, Cookie Policy and Refund & Prize Claim Policy form the agreement between you and Proper Wins.
If there is an inconsistency, a clear competition-specific term shown before entry takes priority for that competition, followed by these Terms and then the other general policies. Nothing hidden after entry will be used to impose a significant disadvantage.
Legal status of the draws
Proper Wins operates prize draws with a paid route and an alternative free entry route where required. Winners are selected in accordance with the laws of chance. In England, Wales and Scotland, a qualifying free draw may operate outside gambling licensing when it complies with the Gambling Act 2005 requirements. Northern Ireland has separate legislation, including the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985 as amended, and UK-wide promotions must also comply with the rules applying there.
Proper Wins is not licensed, regulated or approved by the Gambling Commission. The Gambling Commission regulates gambling in Great Britain and monitors the boundary between lawful free draws and illegal lotteries.
We use the UK Government’s Voluntary Code of Good Practice for Prize Draw Operators as a compliance benchmark for Great Britain where relevant. This statement does not claim signatory status unless Proper Wins is shown on the official signatory list.
Eligibility
- You must be aged 18 or over and resident in an eligible UK territory stated on the competition page
- You must have legal capacity to enter and must not be prohibited by applicable law
- You must provide complete, accurate and current identity, contact, account and payment information
- Employees, contractors and people materially involved in operating or auditing a draw, and their immediate households, may not enter unless expressly permitted for a clearly identified test or staff promotion
- We may require reasonable proof of age, identity, address, payment ownership and eligibility before accepting an entry or awarding a prize
Accounts and one-person rule
Entries may require a registered account. Accounts are personal, must not be shared, transferred or sold and should normally be limited to one account per person. You are responsible for protecting your password and notifying us promptly of suspected unauthorised access.
We may combine, restrict or close duplicate accounts and may void associated entries or rewards where duplication was used to bypass limits, promotions, restrictions or responsible-play controls.
Competition information
Before entry, the relevant page should identify the material conditions needed to make an informed choice, including how to enter, opening and closing dates, eligibility restrictions, entry price, maximum ticket supply where applicable, maximum entries per person, nature and number of prizes, any cash alternative, draw method and how winners will be notified.
The exact chance of winning may depend on the final number of valid entries. Where a maximum ticket supply is shown, one valid ticket has no worse than a one-in-that-maximum chance of winning the relevant single end prize, subject to multiple prizes and the competition’s stated allocation method.
Paid online entries
Follow the website instructions, select the permitted number of entries and complete payment using an accepted method. An order is not accepted until payment is authorised and the order or tickets are confirmed in our records.
Ticket numbers may be chosen, randomly assigned or allocated automatically as stated on the competition page. If payment is taken after a competition has already closed or sold out, the affected entry will not participate and the payment will be corrected.
Free postal entries
Eligible paid-entry draws provide a free postal route using ordinary first-class or second-class post. The route must be displayed prominently enough for potential entrants to see it before purchase. Valid free and paid entries are treated equally and the winner-selection system does not distinguish between them.
Full requirements, address and deadlines are set out on the Free Entry Route page. One postal communication equals one entry unless a competition-specific rule expressly provides otherwise.
Entry limits and availability
Any account, person, household, transaction or competition limit shown before entry applies to both entry routes where relevant. Attempts to bypass a limit through duplicate accounts, altered details, third parties or automated methods may be rejected.
Entries are subject to remaining availability. A competition may close early if its published maximum number of entries is reached. A closing date will not be extended merely because entries remain unsold.
Draw dates and low ticket sales
A competition will proceed on the advertised closing or draw schedule regardless of low ticket sales, unless it closes earlier because the stated ticket cap is reached or an exceptional event outside reasonable control makes a fair draw impossible or unlawful.
Proper Wins will not reduce the advertised prize, extend the closing date or cancel a draw solely because sales are lower than expected.
Winner selection
End-draw winners will be selected using the method stated on the competition page, such as a verifiably random and auditable computer process, a certified physical draw device or an independently supervised process. The relevant entry list and system records will be preserved for a reasonable audit period.
If a draw is streamed or recorded, a broadcast delay, connectivity failure or recording issue does not invalidate an otherwise fair draw evidenced by the underlying records.
Instant-win formats
An instant-win entry may be linked to a predetermined ticket outcome or another auditable random allocation method explained on the competition page. Any wheel, slot, scratch, card, box or reveal animation is presentational and does not itself determine or alter the recorded result.
Paid and valid free entries must use an equivalent underlying allocation process. Instant-win prizes and remaining availability may change as valid winning tickets are allocated or claimed.
Notification and claiming prizes
We will use the contact information attached to the winning entry and will make reasonable attempts to notify the winner as soon as practicable, normally within two working days after an end draw or within the timeframe stated for an instant win.
You are responsible for keeping contact details current and checking your account and spam folders. We may require verification before release. A non-cash prize that remains unclaimed after reasonable contact attempts and at least 14 days may be redrawn or otherwise dealt with under the competition-specific terms.
A cash winner has 14 days after notification or availability to complete a cash claim. After that, the cash withdrawal option expires, but the full value remains available as non-withdrawable site credit and may be redeemed as credit at any later time.
Prizes and alternatives
The prize is the item, service, cash amount or credit described on the competition page. We will provide the advertised prize or a reasonable cash alternative where one was stated or is agreed with the winner. A lower-value prize will not be substituted because of low ticket sales.
Prizes are personal to the winner and are not transferable unless Proper Wins agrees. Supplier conditions, travel dates, licences, insurance, registration, delivery areas, collection requirements, taxes and ongoing costs may apply where clearly relevant.
Delivery, collection and risk
Delivery or collection arrangements will be stated on the competition page or agreed with the winner. Any material delivery charge or geographical restriction must be disclosed before entry where reasonably foreseeable.
Responsibility for a physical prize transfers to the winner on completed delivery or collection. Proper Wins remains responsible for obligations that cannot lawfully be excluded and for accurately arranging the advertised prize.
Winner information and publicity
To evidence a valid award, Proper Wins may publish or make available limited information, ordinarily the surname and county of a major prize winner. Entrants may object or ask for the amount published to be reduced. We may still provide the information confidentially to the Advertising Standards Authority if challenged.
Photography, video, interviews, testimonials and broader promotional content are optional unless a specific promotion clearly states a lawful condition before entry. Any consent may be managed in accordance with the Privacy Policy.
Site credit, cashback and rewards
Site credit, bonus credit, cashback, free tickets, vouchers and promotional rewards are not cash unless explicitly stated. They are non-withdrawable once applied as credit, personal to the account and cannot normally be transferred or sold.
Site credit does not expire merely because 14 days have passed. It remains available until used, subject to account security, correction of genuine errors, legal requirements and action against fraud or promotion abuse.
Promotions and Proper Pass membership
Any credit-back offer, Power Play, membership, recurring benefit, free-ticket offer or social promotion may have additional clearly disclosed rules. Significant conditions such as eligibility, payment frequency, cancellation, minimum spend, maximum reward and expiry must be communicated before participation.
Proper Pass recurring plans
- Proper Pass renews monthly at the price displayed when you subscribe or, for an eligible Founding Member, at the locked Founder price while the same membership remains continuously active.
- The joining payment is taken immediately. The one-time welcome credit and joining benefits are then applied automatically. Monthly tier credit and automatic tickets into eligible live normal-draw competitions are applied in accordance with the plan shown at subscription.
- Where the Founder offer applies, the following month is free, the normal tier credit and automatic normal-draw ticket allocation are still applied during that free month, and paid monthly renewals begin in month three.
- Included and bonus entries are assigned automatically to eligible live normal-draw competitions through the Proper Wins Games Hub. They are not used for instant-win games, have no cash alternative, are non-transferable and will appear in the member’s ticket history. If no eligible normal draw is live when a reward becomes due, the owed entries remain queued and are retried automatically.
- Plan ticket quantities are maximum monthly allocations and are also subject to the plan’s disclosed monthly retail-value cap and maximum eligible ticket price. The system stops at whichever limit is reached first and spreads eligible entries across available live normal draws.
- New payments and rewards may be paused during self-exclusion, a cool-off, a £0 spend limit, account closure, age/identity review, failed payment, refund, chargeback, fraud review or another proportionate player-protection restriction. Owed rewards that remain valid will be queued rather than silently lost.
- The date of birth already stored on the player account is locked to Proper Pass when membership starts and is used for one birthday reward per birthday year. A birthday change requires manual support review and cannot create another reward. Genuine referrals are unlimited and have no monthly cap; duplicate, self-referral, zero-cash, membership-order, cancelled and refunded-order checks apply automatically.
- You may cancel at any time through My Account. Cancellation takes effect at the end of the current paid or free period, no further automatic renewal payment will be taken, and already issued benefits remain subject to their normal use, expiry, security and misuse rules.
- Because membership credit and benefits are supplied immediately at your request, payments already completed are generally non-refundable merely because you later change your mind or cancel. This does not affect statutory rights, refunds required by law, or remedies for duplicate charges, unauthorised payments or material service failure.
- Proper Pass may be upgraded to a higher tier at any time, including during an active Founder free period. An advertised one-time upgrade discount applies only to the first eligible invoice at the upgraded tier and cannot be repeatedly claimed by changing tiers or rejoining.
- Founding Member pricing is locked while the subscription remains continuously active. Upgrading locks the then-current price of the chosen higher tier; cancelling ends the Founder price lock and it is not restored automatically if the customer later rejoins.
- If a payment is refunded, reversed or charged back, any unused credit, unassigned automatic entries or other benefits linked to that payment may be removed or reversed where lawful and proportionate.
We may prevent abuse, but will not retrospectively change a completed promotion solely to avoid providing a properly earned benefit.
Refer a Friend
Where the referral programme is active, a registered player receives a personal link using their Proper Wins username. A referral is recorded when a genuinely new player follows that link, creates their own account and meets the qualifying conditions shown in the account area.
- The qualifying threshold is based on actual external cash/card spend. Site Credit, free entries, promotional credit, refunded amounts and cancelled or unpaid orders do not count.
- Unless a specific referral campaign states otherwise, each genuine new player can generate one welcome reward for themselves and one reward for the referring player.
- Referral rewards are promotional, non-withdrawable Site Credit. They are personal to the receiving account and cannot be sold, transferred or exchanged for cash.
- Self-referrals, duplicate or controlled accounts, false identities, household/account farming, misleading promotion of the link, refunded qualifying orders and any attempt to manufacture rewards are prohibited.
- We may delay a reward while eligibility, payment or account ownership is checked. Rewards credited because of error, refund, chargeback, duplication or abuse may be reversed.
- Old referral links may continue to redirect for continuity, but the account area will display the current username-based link.
The reward amount and required cash spend are displayed before sharing the link and may be changed for future referrals. A change will not remove a reward already validly earned under the terms shown when the referred player qualified.
Charity-linked promotions
Where a promotion states that a charity or cause will benefit, the competition page or associated material will identify the beneficiary or type of cause, explain how the contribution is calculated, state any cap or minimum and provide updates where appropriate.
Only the amount or basis expressly stated is promised. Participation should not be described as a charitable donation by the entrant unless that is legally and factually correct.
Responsible play and player protection
Proper Wins is for adults only. We may provide spend limits, zero limits, account suspension, self-exclusion, marketing suppression and support signposting. We may also intervene, restrict activity or request additional checks where behaviour appears harmful, excessive, underage, fraudulent or inconsistent with these Terms.
A player-requested temporary suspension will normally be applied for at least six months. During a suspension or self-exclusion period you must not enter through another account or route. Any winning entry validly accepted before the restriction will be handled fairly.
Payments and chargebacks
Available payment methods are those displayed at checkout and may be restricted by card type, competition format, player-protection controls, processor rules or law. You must use a payment method you are authorised to use.
Contact support promptly about a disputed payment. Fraudulent or unjustified chargebacks may result in account restriction, cancellation of affected entries or recovery of direct losses where legally permitted. Genuine statutory and card-scheme rights remain unaffected.
Technical faults and records
Where a display, animation, email, connection, payment, balance or ticket issue occurs, the controlling evidence is the underlying order, payment, ticket, result and server record, subject to investigation of any genuine fault.
We may pause a feature, void an affected transaction and provide a fair replacement or refund where necessary to protect draw integrity. We will not use a minor technical issue to avoid awarding a legitimately recorded prize.
Prohibited behaviour
- Providing false, stolen, incomplete or misleading information
- Entering while under 18, ineligible or subject to an account restriction
- Using multiple accounts, identities or payment methods to evade limits
- Automating entries, scraping, reverse engineering, exploiting errors or interfering with systems
- Abusing free entry, refunds, chargebacks, referrals, credit, promotions or responsible-play tools
- Threatening, harassing or acting unlawfully towards staff, suppliers or other customers
- Using the service for money laundering, fraud or any commercial resale scheme
Suspension, rejection and disqualification
We may reject an entry, withhold a prize pending review, suspend an account or disqualify a participant where there are reasonable grounds to believe these Terms, eligibility rules, entry limits, security requirements or law have been breached.
Decisions will be proportionate and based on available evidence. A prize will only be permanently withheld where qualifying criteria were not met, fraud or material breach is established, or the law otherwise permits.
Refunds and cancellation rights
Paid entries are normally non-refundable after acceptance and allocation, subject to rights that cannot be excluded. By requesting immediate entry and ticket/result allocation, you acknowledge that any statutory cancellation right may be lost once the service is fully performed.
Cancelled competitions, duplicate charges, genuine system faults and other exceptions are covered by the Refund & Prize Claim Policy.
Website availability and intellectual property
Website content, branding, graphics, software and competition materials are owned by or licensed to Proper Wins. They may not be copied, exploited or used commercially without permission.
We do not guarantee uninterrupted website availability, but will take reasonable steps to preserve accepted entries and draw integrity during outages.
Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights or any liability that cannot lawfully be excluded.
Subject to that, Proper Wins is not responsible for indirect or unforeseeable losses, business losses incurred by consumers, failures caused by inaccurate user details, unauthorised account use, ordinary postal delay, device or internet problems, or third-party outages outside reasonable control.
Events outside reasonable control
If an exceptional event such as legal prohibition, serious cyber incident, supplier collapse, payment-system failure, natural disaster or other event outside reasonable control prevents fair performance, we may pause, reschedule or cancel only to the extent reasonably necessary. We will communicate material changes and provide a fair remedy for affected paid entries.
Complaints
Formal complaints should be sent to support@properwins.co.uk with the subject line Formal Complaint. The complaint process, target response times and available escalation routes are set out on the Contact, Complaints & Support page.
Changes to these Terms
We may update these Terms for future entries when services, law, technology or business processes change. The version applying to an entry is the version available when that entry was submitted, together with any competition-specific terms accepted at that time.
We will not make a retrospective material change that unfairly removes a prize or benefit already earned.
General legal terms
If any provision is invalid or unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer your contract or account without permission. Proper Wins may transfer operational rights and obligations as part of a genuine business transfer provided your consumer rights are not reduced.
No person other than you and Proper Wins has a right to enforce these Terms, except where a prize supplier is expressly given that right. These Terms and incorporated policies form the agreement relating to the entry, without limiting liability for fraud.
Governing law and courts
These Terms and any contractual or non-contractual dispute arising from them are governed by the laws of Scotland.
If you are a consumer, you may bring proceedings in the courts of the part of the United Kingdom in which you live and retain any mandatory protections applicable there. In all other cases, the courts of Scotland have exclusive jurisdiction.
